This Privacy Policy applies to Heritage Only Pty Ltd and its affiliates (“we, us, our”) in relation to our operations and explains how we handle personal information and comply with the requirements of applicable privacy laws (“Privacy Laws”), including the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), and the Privacy and Data Protection Act 2014 (Vic). This Privacy Policy is subject to any applicable local Privacy Laws.

We recognise the importance of your privacy, and that you have a right to control how your personal information is collected and used.

1.0 Collection of Personal Information

1.1  We collect personal information from users (including buyers, sellers, event ticket purchasers, event attendees, and others using our platform), contractors, those who access our site and other individuals for various business purposes further described in section 2 below.

1.2  The types of personal information we collect from you will depend on the circumstances of collection. It may include:

  • contact details (e.g. name, address, email and phone number);
  • proof of identity, including a valid Australian Driver’s Licence and proof of residential address;
  • proof of ownership or vehicle registration;
  • date of birth;
  • information on prior dealings with us;
  • event ticket purchase and attendance records;
  • financial information and details, including credit/debit card details; and
  • statistical information regarding use of our websites, including IP addresses and dates and times of visits.

1.3  We usually collect personal information through:

  • our interactions with you;
  • our websites and platform;
  • use of social media;
  • third party service providers;
  • requests for newsletters, brochures, mailing list subscriptions or further product/service information;
  • provision of customer service and support; and
  • responses to surveys or research conducted by us or on our behalf.

1.4  If you do not provide us with the information we request, we may not be able to fulfil the applicable purpose of collection, such as providing access to our website or platform, processing your auction registration, or supplying services to you.

1.5  Where practicable, we will collect personal information directly from you. If we receive information about you from someone else, we will take reasonable steps to ensure you are aware of the collection and its circumstances.

2.0 Use and Disclosure of Personal Information

2.1  We will only use and disclose your personal information in accordance with Privacy Laws and this Privacy Policy.

2.2  Our main purposes for collecting, holding, using and disclosing personal information are:

  • to provide users access to our platform and websites;
  • to facilitate communication and transactions between users;
  • to process auction registrations, bids, purchases, and number plate transfers;
  • to process event ticket purchases and manage event attendance;
  • to respond to enquiries from existing or prospective users;
  • to provide our newsletter and other related material;
  • to contact attendees with updates on future Custom Plates launches, premium events, and upcoming auction opportunities.
  • to enforce agreements between you and us;
  • to undertake research, surveys and statistical analysis; and
  • to comply with our legislative and policy obligations.

2.3  We generally explain at the time we collect personal information how we will use or disclose it. We will only use or disclose personal information for a different purpose if you have consented or such use is otherwise permitted by Privacy Laws.

2.4  In carrying out our business, it may be necessary to share your information with our related bodies corporate and organisations that provide services to us or to whom we provide services. We would not otherwise routinely disclose personal information to another organisation unless:

  • it is required to provide our services to you;
  • required by law;
  • we believe it is necessary to provide a product or service you have requested or will enable us to provide a better product or service to you;
  • it is necessary to protect the rights, property or personal safety of any customer, member of the public, or our interests;
  • our business assets are transferred to another party as a going concern; or
  • you have provided your consent.

3.0 Disclosure of Personal Information to State Authorities

3.1  By using our Website, participating in any Auction, purchasing a ticket to or attending any event conducted or facilitated by Heritage Only, you expressly consent to Heritage Only disclosing your personal information to relevant State and Territory road and transport authorities (“State Authorities”), including but not limited to:

  • VicRoads (Roads Corporation) in Victoria;
  • Transport for NSW (TfNSW) in New South Wales; and
  • their respective successors or equivalents in other States and Territories.

3.2  Such disclosure will only occur where reasonably necessary for one or more of the following purposes:

(a)  to facilitate the transfer, registration, or administration of number plate rights or vehicle registration entitlements;

(b)  to verify the identity of event attendees, bidders, purchasers, or vendors in connection with road transport, road safety, or vehicle registration purposes;

(c)  to facilitate compliance with applicable road transport legislation, including the Road Transport Act 2013 (NSW), the Road Safety Act 1986 (Vic), and equivalent legislation in other States and Territories;

(d)  to fulfil Heritage Only’s obligations as an authorised auctioneer or service provider operating in partnership with a State Authority; or

(e)  as otherwise required or authorised by law.

3.3  The personal information that may be disclosed to State Authorities includes, but is not limited to, your name, address, contact details, date of birth, driver’s licence details, and event attendance records, to the extent reasonably necessary for the purposes in clause 3.2.

3.4  Heritage Only will take reasonable steps to ensure that any personal information disclosed to State Authorities is handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and applicable State or Territory privacy legislation.

3.5  If you do not consent to your personal information being shared with State Authorities as described in this section, you should not use the Website, participate in any Auction, or purchase a ticket to or attend any Heritage Only event. Heritage Only may be unable to provide certain services to you if this information cannot be shared.

4.0 Service Providers

4.1  Like most organisations, we use a range of service providers to help us maximise the quality and efficiency of our services and business operations. This means that individuals and organisations outside of Heritage Only, such as organisations which facilitate financial transactions, web hosting providers and mail houses, will sometimes have access to personal information held by us and may use it on our behalf. We require our service providers to adhere to strict privacy guidelines and not to keep this information or use it for any unauthorised purposes.

5.0 Disclosure of Information Outside Australia

5.1  We may disclose personal information outside of the jurisdiction from which it was collected. In the conduct of our business, we may transfer to, hold or access personal information from various countries outside Australia. The Privacy Laws of those countries may not provide the same level of protection as Australian Privacy Laws. However, this does not change our commitments to safeguard your privacy and we will comply with all applicable laws relating to cross-border data disclosure.

6.0 Direct Marketing

6.1  From time to time, we send marketing materials to current or prospective customers. We only do so in accordance with applicable laws or with your prior consent. Where we have shared your information with a third party in connection with a specific product or service you have requested, it is possible that this third party may wish to send you marketing materials relevant to that specific product or service.

6.2  By providing your details or otherwise engaging with our website or services, you acknowledge that:

  • we may use your information to send you communications about Heritage Only, including marketing material; and
  • if applicable, a third party with whom we have shared your information in connection with product or service requested by you may use your information to send you communications regarding that product or service, including marketing material.

You may opt out of receiving marketing communications at any time by following the instructions in our messages or by contacting us directly.

6.3  If you are receiving promotional information from us and do not wish to receive it any longer, please contact us using the details in section 14 and ask to be removed from our mailing lists, or use the unsubscribe facilities included in our marketing communications.

7.0 Links to Other Websites

7.1  Our websites may contain links to third party websites. These linked sites are not under our control and we are not responsible for their content, nor are those sites subject to our Privacy Policy. Before disclosing your personal information on any other website, we recommend you examine the terms and conditions and privacy policy of the relevant site. We are not responsible for any practices on linked websites that might breach your privacy.

8.0 Employee Information

8.1  This Privacy Policy does not apply to the handling of information about employees by us. For information about our practices relating to employee information, please contact us using the details in section 14.

9.0 Accessing and Correcting Your Information

9.1  If at any time you want to know what personal information we hold about you, you are welcome to request access by contacting us.

9.2  If you wish to change personal information we hold because it is inaccurate or out of date, please contact us and we will amend your record. If you wish to have your personal information deleted, please contact us and we will take all reasonable steps to delete it unless we need to retain it for legal reasons.

10.0 How We Hold and Secure Your Personal Information

10.1  We may hold personal information in paper and/or electronic form. We will endeavour to take all reasonable steps to keep your information secure, accurate, up to date and complete. We require our employees and data processors to respect the confidentiality of any personal information held by us.

11.0 Retention of Information

11.1  When we no longer need to use your information, we will take steps to properly de-identify or destroy it.

12.0 Cookies

12.1  Cookies are small text files stored on your computer or mobile device when you visit our websites. A cookie will usually contain the name of the website it came from, its “lifetime” (how long it remains on your device), and a value (usually a randomly generated unique number).
